    OR A STATE CIVIL EMPLOYEE

    1. The applicant has the right to file a complaint against the decision and (or) action (inaction) of the authorized body, an official of the authorized body or a state civil servant in the provision of a public service (hereinafter referred to as the complaint).

    2. The subject of the complaint includes, among other things, the following decisions and actions (inaction):

    1) violation of the deadline for registering the applicant’s request for the provision of a public service;

    2) violation of the deadline for the provision of public services;

    3) requesting from the applicant documents not provided for by the regulatory legal acts of the Russian Federation for the provision of public services;

    4) refusal to accept documents from the applicant, the submission of which for the provision of public services is provided for by the regulatory legal acts of the Russian Federation;

    5) refusal to provide a public service, if the grounds for refusal are not provided federal laws and other regulatory legal acts of the Russian Federation adopted in accordance with them;

    6) the requirement from the applicant for the provision of public services of a fee not provided for by the regulatory legal acts of the Russian Federation;

    7) refusal of an authorized body, an official of an authorized body, a state civil servant to correct typographical errors and (or) errors in documents issued as a result of the provision of public services, or a violation of the established deadline for such corrections.

    3. The complaint is submitted to the authorized body in writing on paper, including when receiving the applicant in person, or electronically.

    4. If the complaint is submitted through a representative of the applicant, a document confirming the authority to take actions on behalf of the applicant is also submitted. The following may be submitted as a document confirming the authority to carry out actions on behalf of the applicant:

    a) a power of attorney issued in accordance with the legislation of the Russian Federation (for individuals);

    b) a power of attorney issued in accordance with the legislation of the Russian Federation, certified by the seal of the applicant (if any) and signed by the head of the applicant or a person authorized by this head (for legal entities);

    c) a copy of the decision on appointment or election or order on the appointment of an individual to a position, according to which such an individual has the right to act on behalf of the applicant without a power of attorney.

    5. A written complaint can also be sent by mail.

    If a complaint is filed in person, the applicant presents a document proving his identity in accordance with the legislation of the Russian Federation.

    A complaint can be submitted electronically by the applicant using the official website of the authorized body, portals of state and municipal services.

    When filing a complaint electronically, the documents specified in paragraph 82 of these Regulations may be presented in the form of electronic documents signed with an electronic signature, the type of which is provided for by the legislation of the Russian Federation, and no identification document of the applicant is required.

    6. The complaint must contain:

    a) the name of the body providing the public service, an official of the body providing the public service, or a state civil servant whose decisions and actions (inaction) are being appealed;

    b) last name, first name, patronymic (the latter - if available), information about the place of residence of the applicant - an individual or name, information about the location of the applicant - a legal entity, as well as contact telephone number (numbers), address (addresses) email(if available) and postal address to which the response should be sent to the applicant;

    c) information about the appealed decisions and actions (inaction) of the authorized body, an official of the authorized body or a state civil servant;

    d) arguments on the basis of which the applicant does not agree with the decision and actions (inaction) of the authorized body, an official of the authorized body or a state civil servant. The applicant may submit documents (if any) confirming the applicant’s arguments, or copies thereof.

    7. If making a decision on a complaint is not within the competence of the authorized body, within 3 working days from the date of its registration, the authorized body sends the complaint to the body authorized to consider it and informs the applicant in writing about the redirection of the complaint. In this case, the period for consideration of the complaint is calculated from the date of registration of the complaint with the body authorized to consider it.

    8. A complaint received by the authorized body is subject to consideration by an official of the authorized body authorized to consider complaints (hereinafter referred to as the official authorized to consider complaints).

    9. The official authorized to review complaints ensures:

    a) receiving and considering complaints;

    b) sending complaints to the body authorized to consider them in accordance with paragraph 85 of these Regulations.

    10. Complaints against decisions made by the head of the authorized body are submitted:

    the highest official of a constituent entity of the Russian Federation;

    to the Federal Service for Supervision in Education and Science.

    11. A complaint received by the authorized body must be registered no later than the next working day from the date of its receipt. The complaint is considered within fifteen working days from the date of its registration, if more short terms consideration of the complaint has not been established by the authorized body.

    In the event of an appeal against the refusal of the authorized body, an official of the authorized body to accept documents from the applicant or to correct typographical errors and (or) errors, or in the event of an appeal against a violation of the established deadline for such corrections, the complaint is considered within 5 working days from the date of its registration.

    12. There are no grounds for suspending the consideration of a complaint by the legislation of the Russian Federation.

    13. Based on the results of consideration of the complaint, the authorized body makes one of the following decisions:

    1) satisfies the complaint, including in the form of cancellation decision taken, correction of typos and (or) errors made by the authorized body in documents issued as a result of the provision of public services, return to the applicant cash, the collection of which is not provided for by the regulatory legal acts of the Russian Federation, as well as in other forms provided for by the legislation of the Russian Federation;

    2) refuses to satisfy the complaint.

    14. If the complaint is satisfied, the authorized body takes comprehensive measures to eliminate the identified violations, including issuing the result of the public service to the applicant, no later than 5 working days from the date of the decision specified in paragraph 91 of these Regulations, unless otherwise established by the legislation of the Russian Federation.

    15. The response based on the results of consideration of the complaint is signed by the official authorized to consider complaints.

The current system in the Russian Federation additional education(DO) allows adults and children to gain knowledge that goes beyond the compulsory state educational standards.

You can get it on a paid or free basis in budgetary and commercial educational institutions.

Since 2015, individual entrepreneurs have received the right to provide services in this area.

CE programs for children and adults have different goals. The first ones are aimed at developing the child and his horizons. Services for children are provided in circles and clubs.

DO for adults is postgraduate training. The need for it arises among specialists in various fields of activity.

Additional knowledge and profession increase the value of any employee in the labor market. You can get DO on a paid or free basis. To do this, you must have a higher or secondary specialized education.

  • Advanced training (designed to teach new skills to workers in various fields of activity within their profession).
  • Retraining (as part of the program, people receive a new profession).
  • Internship (the purpose of training is to consolidate theoretical knowledge in practice).

Important! The presence of a preschool education is confirmed by a diploma, certificate or certificate.

These documents have legal and image force if they are issued by educational institutions operating on the basis of an appropriate license. All additional education programs comply state standards.

Do I need permission?

In 2015, the Russian Federation adopted Federal Law No. 99 regulating licensing activities in the country.

In preschool education, it is carried out by types and levels of education, professions, specialties and other indicators. A license is an official permit document. It may be in paper or electronic format.

The procedure for issuing a license is determined by three main regulations:

  • Federal Law No. 273 (2012);
  • Federal Law No. 99 (2011);

Reference! There is no need to obtain a license for organizations that do not issue documents on additional education and conduct trainings and seminars.

Who issues?

The list of organizations issuing licenses for educational activities is determined in article 3 Federal Law No. 283. This right is granted to federal and regional executive authorities:

  • ministries;
  • committees and departments of education.

PP No. 966, adopted in 2013, granted the right to issue. After receiving an application for a permit, they must issue a license within 45 days. License validity period is defined Article 9 of Federal Law No. 99. It is issued indefinitely.

Subspecies of DOs subject to licensing

Organizations providing subsidiaries services, regardless of their form of ownership are required to obtain a license for their activities if they are engaged in:

  • preschool or general education;
  • professional training of specialists or their retraining.

Services can be provided by both commercial and non-profit organizations. Current legislation does not require tutors and private teachers to obtain a license.

There is no need to receive it for those organizations that do not conduct certification and do not issue documents on the education received. Their training services are cultural or leisure.

Difference before for children and adults

DO for adults aimed at vocational and technical training of qualified specialists. Their training programs are compiled in accordance with the needs of the customer of the service.

Goal for pre-children- solving educational problems. It is aimed at developing the child’s creative potential and expanding his horizons.

Requirements for applicants

The list of requirements for license applicants is defined in PP No. 966.

They must have:

  1. The room in which the educational process will be conducted. It must be owned or long-term leased by the service-providing organization.
  2. Necessary for carrying out educational process materially technical support.
  3. Programs and teaching methods that meet state standards;
  4. SEZ on compliance of the organization of the educational process with SaNPiN.

The premises used for educational activities are subject to safety requirements and labor and health standards. The staff of organizations conducting educational activities must include: specialists of relevant qualifications.

Receipt cost

When obtaining a permit, a fee is paid state duty and invoice for examination.

The amount of state duty, in accordance with the Tax Code of the Russian Federation, is 7500 rubles.

The cost of an expert opinion depends on scope of work and is determined by agreement of the parties.

Required documents

A permit is issued based on application. It has standard form, which is being developed by regional bodies of the Ministry of Education. A package of documents is submitted along with it. It consists of:

  1. Notarized copies of documents providing complete information about the applicant (charter, constituent agreement, TIN, ORGN, etc.).
  2. Certificate of ownership or long-term lease agreement for premises intended for educational activities.
  3. Curricula and plans.
  4. Certificate of material and technical equipment.
  5. Sanitary report on the suitability of the premises.
  6. Conclusion of the State Fire Supervision Authorities.
  7. Receipt for payment of state duty.

After submitting the documents, the applicant is issued a license or a reasoned written refusal.

How to get: algorithm

To carry out educational activities it is necessary register as a legal entity or individual entrepreneur.

Current legislation allows the provision of subsidiary services to organizations of all forms of ownership. What follows:

  1. Find a place to work and bring it into compliance with safety, sanitation and hygiene requirements.
  2. Develop and approve methods and training programs.
  3. Pay the state fee.
  4. Submit documents for activity licensing.

The decision to accept an application for licensing is made within 3 working days from the moment of its submission.

The period for reviewing documents, according to current legislation, cannot exceed 60 days.

Penalties for working without permission

Providing subsidiary services without permits entails administrative or criminal liability under Article 171 of the Criminal Code of the Russian Federation. It provides for punishment for company managers and individual entrepreneurs in the form of:

  • fine up to 300 thousand rubles;
  • completing compulsory work in the amount 480 hours;
  • arrest before 6 months.

A more severe punishment is provided for a group of persons who have violated the legislation in force in the field of providing educational services. The fine for them has been increased up to 500 thousand rubles, and the term of arrest is up to 5 years.

Requirements for the provision of additional education services have been determined Federal Law No. 273. Its effect applies to educational institutions of all forms of ownership.

Educational activities in the Russian Federation are subject to licensing. The process is long and unpleasant, but only teachers who provide individual training services can avoid it. Who needs an educational license?

The procedure for licensing educational activities is regulated by a number of legislative acts:

  • general education schools (primary, basic, complete secondary);
  • vocational education (schools, colleges, universities, postgraduate education);
  • additional education for children and adults (courses, linguistic centers, etc.);
  • other forms of training and education.

Thus, almost all organizations related to education fall under the scope of regulatory framework about licensing. But there are exceptions:

  • one-time lectures, seminars, trainings, after which certification is not carried out and “certificates” of education are not issued on official forms;
  • Individual entrepreneurs who personally give private lessons without the involvement of other employees (tutors, speech therapists, etc.)

Requirements for obtaining an educational license

The regulations on licensing educational activities establish a lot of conditions for applicants, which makes this process very labor-intensive and time-consuming. From the moment of registration of a legal entity/individual entrepreneur until the receipt of permission, it can take more than one month, and collecting the necessary documents here is not the most difficult thing.

Solving the problem of how to obtain a license for educational activities should begin with studying the requirements for premises, equipment, teaching staff, training programs and other nuances. They will depend on the type of institution, the age of the students, and the time that students will spend in classes. You will need sanitary and fire regulations, methodological recommendations for the development of educational programs, preliminary schedule, staffed specialists. But first things first.

  1. For educational institution It is not enough to just have a legal address. He must have premises suitable for the purposes of training in accordance with all statutory standards. Depending on the type of institution, special requirements may be imposed on the minimum size, number of rooms, the presence of a separate entrance, area for the site, etc. Arm yourself with SNiP and SanPiN, look for the standards for your type of activity and select the appropriate premises.
  2. To obtain a license, you will need all the title documents for the property. Even before concluding a lease or purchase and sale agreement, check whether everything is “clean” with the papers.
  3. Bring the premises into proper shape and in accordance with fire and sanitary safety standards. Make repairs using recommended materials, install an alarm system, provide fire extinguishing equipment, take care of proper lighting, comfortable temperature conditions, etc. When everything is ready, invite employees of the SES and State Fire Supervision to draw up a safety report. Special attention: if students will receive meals, they will have to equip a kitchen and a place for eating, and obtain permission from Rospotrebnadzor for this.
  4. Furniture, equipment, and inventory must also meet safety and sanitary standards. For goods purchased for children's institutions, request certificates.
  5. You cannot get a license without educational programs. If you are not familiar with this area, it will be difficult for you to independently develop documents that comply with state standards. Entrust this to your teachers. As a last resort, take the programs of other institutions as a model or pay for the work of an experienced methodologist. Approve each program with the signature of the manager.
  6. Teaching staff educational institution must be generated before submitting an application for a license. The relevant education, qualifications and length of service of employees must be confirmed by relevant documents.
  7. Don’t forget to purchase educational literature, teaching aids, equipment and technology for conducting classes.

List of documents for a license

To obtain a license for the educational activities of an LLC, you must present the following set of documentation to the Ministry of Education:

  1. Charter of the legal entity (notarized copy).
  2. State registration certificate (OGRN). Certificates of amendments to the Unified State Register of Legal Entities, if any. All copies are notarized.
  3. Decisions on the creation of an LLC, on making changes (copies signed by the director).
  4. Certificate of tax registration (TIN).
  5. Title documents for educational premises and territories (registered lease agreement, certificate of ownership).
  6. Curricula approved by the head. If necessary, agreed and certified according to the profile.
  7. Curricula: type of education, level, name of the program and terms of its completion, teachers.
  8. Information about employees: copies of diplomas and work books of teaching staff.
  9. A certificate confirming the material and technical equipment of educational activities. The document is drawn up in the form approved by the Ministry of Education and Science (Order No. 1032 of December 11, 2012) and signed by the director.
  10. Sanitary report from Rospotrebnadzor on the suitability of the premises for educational events.
  11. Certificate of availability of conditions for nutrition and health protection of students (if necessary).
  12. Conclusion of the State Fire Inspectorate.
  13. If a license is obtained for a branch, structural unit– decision on establishment, certificate of registration, Regulations on the branch in copies.

The head of the organization must submit the application with the attached documents and passport to the licensing authority. In the subjects of the federation, these are education management bodies - regional, republican, regional ministries, departments and committees. It is possible to send an application by mail.

Individual entrepreneurs working with the involvement of third-party teachers operate in a similar way, with the exception of minor differences in the list of papers: they do not have constituent documents. Otherwise, everything is the same, but professional registrars claim that it is more difficult for an individual entrepreneur to obtain a license for educational activities than for a legal entity.

Licensing procedure

The licensing authority accepts the application according to the inventory, affixing a mark of receipt. The date indicated on the inventory is the moment from which the procedure officially begins:

  1. No more than three days, specialists from the Ministry of Education evaluate the applicant’s documents for completeness and correctness of completion. If any deficiencies are found, the papers are returned to the applicant for revision - the correction period is 30 days.
  2. If there are no complaints about the documentation, the inspection stage begins. The reliability of the information and the compliance of the applicant’s conditions with the licensing requirements are studied - both on paper and on site. On-site control is carried out in agreement with the applicant and in compliance with his legal rights.
  3. The Office for Supervision in the Educational Sphere accepts approval or denial of a license within 60 days from the date of registration of the application. If, based on the results of the inspection, experts consider issuing a permit inappropriate, such a decision must be justified. The refusal is legal only for two reasons: provision of false information and conditions that are not suitable for conducting licensed activities.
  4. An issued educational license is valid indefinitely, but the Ministry of Education and Science has the right to suspend or revoke it if the licensee violates the established requirements.

Disagreement with a negative verdict, as well as actions of inspectors that go beyond the scope of their authority, can be appealed by the applicant in court.

Should I get a license?

Difficulties in obtaining an educational license give training organizations a completely understandable desire: to avoid this procedure. Commercial firms engaged in sublicensed activities without the appropriate documents fall under the article on illegal entrepreneurship. Responsibility for this offense is provided:

  • administrative sanctions in the form of a fine of 2000 rubles. for individuals up to 50,000 rubles. – for legal entities (Article 14.1 of the Administrative Code);
  • criminal punishment - a fine of up to 300,000 rubles, arrest for up to 6 months, forced labor for up to 480 hours (Article 171 of the Criminal Code);
  • criminal prosecution for a group of persons - imprisonment for up to 5 years, fine - up to 500,000 rubles.

When we're talking about about non-profit educational institutions, they have no other choice but to work with the permission of the Ministry of Education and Science. But even here there are violations. They are subject to administrative liability for operating without a license: a fine of up to 250,000 rubles. under article of the Code of Administrative Offenses 19.20 part 1.

In any case, the punishment for not having a license is quite serious. The losses that occur as a result of administrative, and even more so, criminal prosecution, are not commensurate with the efforts that have to be made to obtain permits.

License for educational activities is a special document that makes it possible to engage in educational activities and provide relevant services. However, it is immediately worth noting that this educational license is not needed for individual entrepreneurs who are engaged in tutoring or have a private club, studio or similar structure. True, if these services are provided not by you personally, but by invited teachers, then in this case a license is required.
